FDNY Violations Removal
The FDNY (Fire Department of New York) can issue violations if a property is not compliant with the New York City Fire Code or other Fire Department Rules. FDNY can issue in the order of least severe to most severe a Notice of Violation, Violation Order, Criminal Summonses and a Vacate Order.
Once the violation is removed a Certificate of Correction will need to be filed. Along with the correction form proof must be provided such as copies of any bills, receipts, photos, and/or other proof for the FDNY to review. If the FDNY approves the Certificate of Correction before the date on the violation a dismissal of the violation will be made and no court appearance and penalty will be imposed. If this cannot be done the owner must attend the hearing and show any proof of correction if available. If the owner believes that it will be difficult to correct by the time indicated on the violation a stipulation can be made at the hearing to increase the time for compliance. The stipulation will be subject to the approval of the FDNY and the ECB.
